AGB
These Terms of Use (the “Terms”) apply to the Atelier Ferro online store (the “Website”). The Website is operated by Atelier Ferro (“we”, “us” or “our”). The “Customer”, “you” or “your” means any adult purchasing Products for personal use.
By visiting the Website or placing an Order, you agree to these Terms. Our Privacy and Cookie Policy and Return Policy also apply. Please read these documents carefully before ordering.
1. APPLICABILITY
These Terms apply to the use of the Website and to every offer, Order and purchase agreement between Atelier Ferro and the Customer.
2. ORDERS
2.1 Placing an Order
To place an Order, select the desired Product, model, colour and size, add it to your cart, enter the requested information, choose a payment method and complete checkout.
The first automatic email only confirms that we received your Order. It does not yet mean that payment was successful or that we accepted the Order. You are responsible for providing complete and correct contact, billing and delivery information.
2.2 Discount Codes and Store Credit
Atelier Ferro may issue discount codes or store credit for promotions, returns or individual customer-service solutions. Unless stated otherwise, personal codes may be used once, cannot be exchanged for cash and must be used according to the conditions provided with the code.
2.3 Acceptance
After receiving an Order, we may check the Order information, address, Product availability and payment status. An agreement is concluded when Atelier Ferro accepts the Order and sends a confirmation stating that it will be processed.
2.4 Refusal or Cancellation
We may refuse or cancel an Order if the information is incorrect, incomplete or appears fraudulent; payment is not received; a Product is unavailable; there is an obvious price or administrative error; delivery is impossible; or accepting the Order would violate the law or these Terms.
If we cancel an Order after receiving payment, we will refund the applicable amount using the original payment method, unless another solution is agreed.
3. SHIPPING AND DELIVERY
Orders are prepared and dispatched as soon as reasonably possible. Delivery estimates are not guarantees and may be affected by busy sales periods, carrier delays, customs procedures or circumstances outside our control. Atelier Ferro selects the carrier used for each shipment.
Orders are delivered to the address entered during checkout. The Customer is responsible for ensuring that all information is complete and correct. We are not responsible for delays, failed deliveries or additional costs caused by incorrect or incomplete information supplied by the Customer.
If a parcel is delayed, lost or damaged, contact Customer Support with your Order number, delivery details and a clear explanation. We will review the matter and work with the carrier to find an appropriate solution.
For deliveries outside the European Union, the Customer may be responsible for import duties, taxes, VAT, customs charges or handling fees. These costs are determined by local authorities and are outside Atelier Ferro’s control. International delivery may take longer because of customs clearance or local delivery procedures.
4. PRICES AND PAYMENT
Prices are shown in euros unless stated otherwise. The total price, including applicable taxes and shipping charges, will be displayed at checkout before the Order is submitted.
Atelier Ferro may change prices at any time. Price changes do not affect Orders that have already been accepted. If a price is clearly incorrect because of a technical or administrative error, we may refuse or cancel the Order and refund any payment received.
Payment must be completed using one of the methods offered at checkout. Unless stated otherwise, full payment is required before an Order is processed.
5. CANCELLATIONS AND RETURNS
Consumers in the European Union and the United Kingdom generally have a statutory 14-day right of withdrawal, subject to the conditions and exceptions of applicable law.
Atelier Ferro may offer a longer return period under the conditions stated in our Return Policy. That policy explains the return period, eligible Products, procedure and shipping costs.
Contact Customer Support as soon as possible if you wish to cancel an Order before dispatch. After dispatch, the Product must be returned according to the Return Policy.
You may inspect and try on a Product only as reasonably necessary to determine its nature, characteristics and fit. You may be responsible for any reduction in value caused by unnecessary or excessive handling.
6. COMPLAINTS AND CUSTOMER SUPPORT
You can contact Atelier Ferro using the contact options on the Website. We aim to respond as soon as possible and normally provide a substantive response within 14 days. If more time is required, we will inform you and provide an expected response period.
7. CONFORMITY, WARRANTY AND LIABILITY
Atelier Ferro is legally required to supply Products that conform to the purchase agreement. Please inspect your Order promptly and notify us within a reasonable period if a Product is defective, damaged or incorrect.
When a Product has a manufacturing defect or does not meet applicable legal requirements, we will provide an appropriate solution under Dutch consumer law. Depending on the circumstances, this may include repair, replacement, a price reduction or a refund. Normal wear, accidental damage, misuse, improper care and failure to follow care instructions are not manufacturing defects.
Nothing in these Terms excludes liability that cannot legally be excluded. To the extent permitted by law, Atelier Ferro is not liable for indirect, incidental or consequential loss. Any liability for direct loss will be limited to the purchase price of the relevant Order, unless applicable law requires otherwise.
8. FORCE MAJEURE
Atelier Ferro is not responsible for delays or failures caused by circumstances beyond its reasonable control. These may include pandemics, war, civil unrest, strikes, transport disruption, customs delays, trade restrictions, fire, flooding, earthquakes, power or supply interruptions, carrier problems and supplier failures.
If such an event prevents performance, we may fulfil our obligations within a reasonable additional period. If performance remains impossible, we may cancel the affected part of the agreement and refund Products that cannot be supplied.
9. WEBSITE INFORMATION
We make reasonable efforts to keep Website information accurate and current, but descriptions, images, prices and availability may occasionally contain errors. Product colours and details may also appear different depending on lighting, display settings or the device used. We may correct, update or remove content without prior notice.
10. ACCEPTABLE USE
You must use the Website lawfully. Without our written permission, you may not copy, modify, redistribute or commercially exploit Website content; systematically extract content; interfere with Website security or operation; introduce harmful code; or infringe the rights of Atelier Ferro or another party.
Material submitted through the Website must be lawful and must not infringe copyright, trademarks, privacy or other rights. We may remove prohibited content, restrict access or take appropriate action if these Terms or applicable laws are violated.
11. ACCOUNT SECURITY
You are responsible for keeping your account credentials and password confidential and for activity carried out through your account. Contact us promptly if you believe your account has been accessed without authorisation.
12. INTELLECTUAL PROPERTY
All trademarks, trade names, logos, designs, photographs, videos, text and other Website content belong to Atelier Ferro or their respective owners and are protected by intellectual-property laws. No licence is granted other than the right to use the Website for personal, non-commercial purposes.
13. COPYRIGHT
Unless stated otherwise, all Website content is protected by copyright. It may not be copied, reproduced, distributed, modified, published or commercially used without prior written permission from Atelier Ferro or the relevant rights holder.
14. CHANGES AND GOVERNING LAW
Atelier Ferro may update these Terms when necessary. The latest version will be published on the Website. The version in effect when an Order is placed applies to that Order, unless a change is legally required.
If any provision is invalid or unenforceable, the remaining provisions will continue to apply. These Terms are governed by Dutch law. Mandatory consumer protections available under the laws of the Customer’s country of residence remain unaffected.
